Terms of Use

These Terms of Use ("Terms") are between you and FOP Shostkevych Oleh (individual entrepreneur, Ukraine), operating as BinPilot. They govern your access to and use of BinPilot applications, websites, and related services ("Services"). By accessing or using the Services, you agree to these Terms.

If you do not agree, do not use the Services.


1. The Service

BinPilot is a digital inventory and organization platform that helps users catalog, track, and manage physical items. Some features are powered by automated systems branded as Pilot Intelligence.

BinPilot is not a medical, legal, financial, or professional advisory service.


2. Eligibility

You must be at least:

  • 13 years old (or 16 where required by law) to use the Services
  • legally capable of entering into a binding agreement

If we become aware that a user does not meet these age requirements, we will terminate their account and delete associated data.


3. Account Responsibility

You are responsible for:

  • maintaining the confidentiality of your account credentials
  • all activity occurring under your account
  • ensuring your account information is accurate and up to date

BinPilot is not responsible for unauthorized access resulting from your failure to secure your account.


4. User Content

You retain ownership of content you upload (photos, text, metadata).

By using the Services, you grant BinPilot a limited, non-exclusive, worldwide license to store, process, and display your content solely to provide the Services.

You represent that:

  • you have the right to upload the content
  • your content does not violate laws or third-party rights

We may remove content that violates these Terms or applicable law.


5. Pilot Intelligence & AI Features

Some features rely on automated processing and third-party AI services, including OpenAI.

Important limitations:

  • AI-generated output may be inaccurate, incomplete, or outdated
  • Output is provided for informational and organizational purposes only
  • You are solely responsible for verifying and using AI-generated content

BinPilot does not guarantee accuracy and is not liable for decisions or actions taken based on AI output.

Your content is not used to train AI models. Data sent to third-party AI providers is used solely to generate responses within the Services and is not retained by those providers for training purposes.


6. Medical, Health & Safety Disclaimer

BinPilot and Pilot Intelligence do not provide medical, pharmaceutical, or healthcare advice.

Any references to:

  • medications
  • supplements
  • medical supplies
  • health-related items

are organizational only.

AI recommendations must never be treated as a substitute for professional medical advice. Always consult a qualified physician or pharmacist.

BinPilot disclaims all liability related to health decisions made using the Services.


7. Acceptable Use

You agree not to:

  • use the Services for unlawful purposes
  • upload illegal, harmful, or infringing content
  • attempt to reverse engineer or abuse the Services
  • interfere with system security or availability
  • use the Services to provide regulated advice (medical, legal, financial)

8. Subscriptions & Payments

Some features may require a paid subscription.

  • Prices and billing terms are disclosed at purchase
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
  • You may cancel your subscription at any time; access continues until the end of the current billing period

Apple App Store Subscriptions

If you subscribe through the Apple App Store, the following terms apply:

  • Payment will be charged to your Apple ID account at confirmation of purchase
  • Your subscription automatically renews unless you cancel it at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period, at the same price
  • You can manage and cancel your subscriptions by going to your Apple ID account settings on your device
  • Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription
  • Refunds for App Store purchases are handled by Apple in accordance with their refund policies

Google Play Subscriptions

If you subscribe through Google Play, the following terms apply:

  • Payment will be charged to your Google account at confirmation of purchase
  • Your subscription automatically renews unless you cancel it at least 24 hours before the end of the current period
  • You can manage and cancel your subscriptions in Google Play Store settings
  • Refunds for Google Play purchases are handled by Google in accordance with their refund policies

Web Purchases

  • Web purchases (Paddle): You may request a refund within 14 days of purchase by contacting [email protected]. Refunds after 14 days are evaluated on a case-by-case basis
  • Refunds are not available for partially used billing periods after the 14-day window

Cancellation

You can cancel your subscription at any time. Depending on your purchase platform:

  • Apple: Manage or cancel in your Apple ID account settings on your device
  • Google: Manage or cancel in Google Play Store settings
  • Web: Contact [email protected]

Cancellation takes effect at the end of the current billing period. No refund will be issued for the remaining days of the current period unless required by applicable law.

EU/EEA Right of Withdrawal

If you are a consumer in the EU/EEA, you have the right to withdraw from a web purchase within 14 days without giving a reason, in accordance with the Consumer Rights Directive. To exercise this right, contact [email protected].


9. Service Availability

The Services are provided "as is" and "as available."

We do not guarantee:

  • uninterrupted access
  • error-free operation
  • permanent availability of any feature

We may modify, suspend, or discontinue any part of the Services at any time.


10. Data Loss

While we take reasonable security measures, no system is infallible.

BinPilot is not responsible for:

  • accidental deletion
  • data corruption
  • loss of user content

except where required by law.


11. Third-Party Services

The Services may depend on third-party infrastructure or integrations.

BinPilot is not responsible for:

  • third-party outages
  • third-party errors
  • third-party policy changes

Third-party services operate independently under their own terms.


12. Data Export & Account Deletion

You may request a copy of your data or deletion of your account at any time by contacting [email protected].

  • Data export requests will be fulfilled within 30 days
  • Account deletion will permanently remove your data from our systems, except where retention is required by law

13. Termination

We may suspend or terminate your access if:

  • you violate these Terms
  • required by law
  • necessary to protect the Service or other users

You may stop using the Services at any time.


14. Limitation of Liability

Nothing in these Terms excludes or limits liability for:

  • death or personal injury caused by negligence
  • fraud or fraudulent misrepresentation
  • any liability that cannot be excluded or limited under applicable law

Subject to the above, to the maximum extent permitted by law:

  • BinPilot is not liable for indirect, incidental, special, or consequential damages
  • This includes loss of data, profits, or business opportunities
  • Total liability shall not exceed the amount paid by you in the 12 months preceding the claim

15. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold BinPilot harmless from claims arising from:

  • your use of the Services
  • your content
  • your violation of these Terms or applicable laws

16. Governing Law

These Terms are governed by the laws of Ukraine.

If you are a consumer in the EU/EEA, you also benefit from mandatory consumer protection provisions of the laws of your country of residence.

If you are a consumer in the UK, the laws of England and Wales apply alongside any mandatory protections under UK consumer law.


17. Dispute Resolution

For EU/EEA consumers: You may refer disputes to the Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

For all users: Before initiating formal proceedings, you agree to attempt to resolve disputes informally by contacting [email protected]. If we cannot resolve the dispute informally within 30 days, either party may pursue formal remedies.


18. Privacy Policy

Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

By using the Services, you acknowledge that you have read and understood our Privacy Policy.


19. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 30 days before they take effect.

For EU/EEA users, material changes require your affirmative consent where required by law.

If you do not agree to the updated Terms, you may stop using the Services before the changes take effect.
